Terms & Conditions

Please refer to the terms and conditions below for the Ivy Home™️ Referral Program (“Referral Program”) brought to you by Ontario Charging Network LP (“Ivy” or “Ivy Charging Network”). These Terms and Conditions outline the rules and guidelines governing participation in the Referral Program and the responsibilities of all participants. By participating in this program, both referrers and referred customers agree to comply with these Terms and Conditions, which are intended to ensure fairness and protect participant privacy.

1. Eligibility requirements.

1.1 Referrer eligibility: Only existing Ivy customers who have purchased and successfully installed an Ivy Home™️ Smart Charger with an installation package from Ivy are eligible to participate as referrers.

1.2 Referred customer eligibility: Referred customers must purchase an Ivy Home™️ Smart Charger along with the installation package to qualify for the Referral Program’s benefits. Purchases of standalone chargers without the installation package are not eligible for this program.

1.3 Residency requirements: Participants must be residents of jurisdictions where Ivy operates and is authorized to provide its products and services. Referrals made outside these regions are not eligible for program rewards or discounts.

2. Referral rewards and discounts.

2.1 Referrer reward: Upon successful referral, verified by the completion of the referred customer’s Ivy Home Smart Charger installation, the referrer will receive a $25 gift card through a third-party service (“Tremendous”). Tremendous offers gift card(s) from a variety of popular brands. The referrer will not receive the gift card if the referred customer’s installation is incomplete or canceled. Referrers will have 1 year or 365 days from the date of issue to redeem their gift card.

2.2 Referred customer discount: The referred customer will receive a $75 discount applied to the final invoice, provided they purchase an Ivy Home™️ Smart Charger with the installation package. Referred customers will need to ensure that they use their referrer’s unique link to complete their purchase in order to receive the discount, and for the referrer to receive the referrer reward.

2.3 Non-transferability: Referral Program rewards and discounts are non-transferable, non-exchangeable, and may not be substituted or combined with other Ivy promotions unless explicitly stated by Ivy.

3. Program limitations.

3.1 Limit of one reward per referral: A referrer may only earn one reward per successful referral. The $75 discount is valid for one transaction only, and multiple discounts cannot be combined on a single order.

3.2 Multiple referrals: Referrers may make multiple referrals; however, they will only receive rewards for each referral that results in a completed installation under the program’s terms.

3.3 Sharing and tracking: Referred customers must use the unique link shared to them by their referrer to complete their purchase. The unique referral link allows referrals to be tracked to ensure both the referrer and the referred customer receive their reward or discount. Ivy is not responsible for issuing rewards or discounts for purchases made without the proper intended use of the referral links. Ivy cannot be held liable for any losses arising from the failure to use the referral link correctly.

4. Privacy and confidentiality.

4.1 Data collection and use: Ivy will collect, use, and retain participants’ personal information solely for the purposes of tracking referrals, issuing rewards, enhancing program efficiency, and improving business and operational performance. All personal information will be handled in accordance with Ivy’s Privacy Policy.

4.2 Confidentiality Obligations: Participants agree not to disclose or misuse any proprietary information provided by Ivy as part of the program.

5. Fraud prevention and misuse.

5.1 Prohibited activities: Any attempt to manipulate, exploit, or defraud the Referral Program, including creating fake accounts, providing false information, or using unauthorized referral methods (e.g., bulk email distributions, advertising on third-party websites, etc.), will result in disqualification from the program and forfeiture of all rewards.

5.2 Investigation and suspension: Ivy reserves the right to investigate any participant suspected of violating these Terms and Conditions and to suspend or terminate participation if fraudulent or abusive activity is identified.

6. Disclaimer of liability.

6.1 Program modifications: Ivy reserves the right to modify, suspend, or terminate the Referral Program at any time, with or without notice. Ivy is not liable for any program changes or discontinuation and assumes no responsibility for referral rewards or discounts unissued due to program termination.

6.2 Limitation of liability: Ivy is not responsible for any losses, damages, or injuries arising from participation in the Referral Program or from any referrals made by participants, including but not limited to delays in referral processing or system failures.

6.3 Indemnification: By participating in the Referral Program, participants agree to indemnify and hold Ivy Charging Network harmless from any claims, liabilities, damages, and expenses arising from any breach of these Terms and Conditions or misuse of the Referral Program.

7. Governing law and dispute resolution.

7.1 Applicable law: These Terms and Conditions shall be governed by and construed by the laws of Ontario and the laws of Canada applicable in Ontario.

7.2 Dispute resolution: Any disputes arising from participation in the Referral Program shall be resolved through binding arbitration in the jurisdiction of Ivy’s principal location. Participants waive the right to a jury trial or to participate in a class-action lawsuit.

8. Acceptance of terms.

By participating in the Referral Program, participants acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions. Ivy reserves the right to update these Terms and Conditions at any time, and it is the participant’s responsibility to review them periodically.
